A day after state officials threatened to kick developer EnCap Golf Holdings off a $1 billion venture to turn Meadowlands landfills into golf courses and luxury housing developments, the Department of Environmental Protection has demanded a $3.3 million payment from the troubled company. In a "demand for payment" dated Sept. 19 that was released yesterday, Irene Kropp, assistant DEP commissioner for site remediation, says EnCap owes the state the money because it has not been able to live up to a 2004 promise to accept thousands of cubic yards of dredged fill dirt. The $3.3 million is the additional cost the state expects to incur for disposing of the material elsewhere, the DEP notice says. EnCap has 30 days to pay the penalty or face a lawsuit, the letter says.
